TERMS OF SERVICE

These Terms of Service govern access to TurboSmooth.ca and the purchase and use of products and services offered by TurboSmooth.
Throughout these Terms, “TurboSmooth,” “we,” “us” and “our” refer to TurboSmooth. “Customer,” “you” and “your” refer to the person accessing the website or purchasing a product or service.
By accessing the website, creating an account, submitting a custom request or placing an order, you agree to these Terms of Service, our Return and Refund Policy, Shipping Policy and Privacy Policy.
If you do not agree to these Terms, you must not use the website or place an order.

2. ELIGIBILITY
You must be at least the age of majority in your province or territory to place an order independently.
A minor may use the website only with the involvement and permission of a parent or legal guardian.
You represent that the information provided during checkout is accurate and that you are authorized to use the selected payment method.
3. PRODUCTS AND SERVICES
TurboSmooth designs, manufactures and sells 3D-printed products, which may include decorative products, organizers, trays, figurines, jewellery holders, storage products, display pieces, accessories and other general-use items.
We may add, modify or discontinue products, colours, materials, collections or services at any time.
Product availability is not guaranteed until an order has been accepted and payment has been successfully processed.
4. 3D-PRINTED PRODUCT VARIATIONS
Our products are manufactured through additive manufacturing rather than conventional mass-production methods.
Customers acknowledge that 3D-printed products may display:
- visible layer lines;
- seam lines;
- minor support-removal marks;
- slight texture or surface variations;
- slight dimensional differences;
- minor differences between manufacturing batches; and
- minor colour or finish variations.
These characteristics do not necessarily indicate that the product is defective.
Product photographs are intended to represent the product as accurately as reasonably possible. Colours may appear different depending on lighting, photography, material batches and screen settings.
5. PRODUCT DIMENSIONS
Approximate dimensions are provided on the applicable product page.
Customers are responsible for reviewing product measurements before ordering and measuring the space where the product will be displayed, stored or installed.
Photographs may include close-up views or styling arrangements that make a product appear larger or smaller than its actual measurements.
Small manufacturing variations may occur unless a specific tolerance has been expressly confirmed in writing by TurboSmooth.
6. PLA MATERIAL AND HEAT EXPOSURE
Many TurboSmooth products are manufactured using PLA or a PLA-based material.
PLA may soften, warp or deform when exposed to excessive heat. Unless a product page expressly states otherwise, products should not be:
- left inside a hot vehicle;
- placed near a stove, oven, fireplace, heater or radiator;
- exposed to open flame;
- filled with boiling or very hot liquid;
- cleaned in a dishwasher;
- placed in a microwave or conventional oven;
- stored outdoors in extreme temperatures; or
- placed in prolonged direct sunlight where significant heat may build up.
Damage caused by heat exposure, improper storage or use contrary to these instructions is not considered a manufacturing defect.
7. INTENDED USE AND SAFETY
Unless expressly stated otherwise on the product page, TurboSmooth products are intended for indoor decorative, organizational or light-duty general use.
Products are not designed or certified for:
- medical use;
- emergency or life-safety applications;
- protective equipment;
- structural or load-bearing applications;
- automotive safety applications;
- electrical insulation;
- contact with an open flame;
- food preparation or long-term food contact;
- microwave, oven or dishwasher use; or
- use by children as toys.
Products containing magnets, detachable components or small parts may present a choking or ingestion hazard. Keep these products away from young children and pets.
Customers are responsible for using products safely and in accordance with the applicable product description and instructions.
8. FOOD CONTACT
A product is not represented as food-safe merely because it resembles a bowl, tray, container, plate or serving accessory.
Unless the product page expressly states that a product is suitable for a particular type of food contact, it should be used only for wrapped or separately contained food, decorative purposes or non-food storage.
9. CUSTOM AND PERSONALIZED ORDERS
Custom and personalized products may require the customer to supply text, names, dates, dimensions, colours, images, references, design instructions or digital files.
The customer is responsible for reviewing and approving all custom details before production.
Approval of a custom preview, rendering or written specification authorizes TurboSmooth to manufacture the product according to that approved information.
TurboSmooth is not responsible for customer-approved errors, including:
- misspellings;
- incorrect names or dates;
- incorrect dimensions;
- incorrect colour selections;
- low-resolution images;
- inaccurate customer-supplied files; or
- design limitations that were reasonably visible in the approved preview.
Custom and personalized products are final sale except where defective, materially different from the approved specifications or otherwise subject to a mandatory legal remedy.
10. CUSTOMER-SUPPLIED CONTENT AND INTELLECTUAL PROPERTY
By submitting an image, logo, model, design, drawing, file, trademark, text or other material, you represent that:
- you own the material or have permission to use it;
- TurboSmooth’s use of it to complete your order will not violate another person’s rights;
- the content is not illegal, threatening, hateful, defamatory, obscene or fraudulent; and
- the requested product does not violate applicable law.
You grant TurboSmooth a limited, non-exclusive licence to access, reproduce, modify and manufacture from the submitted material solely as reasonably necessary to evaluate, produce and deliver the requested order.
TurboSmooth may reject or cancel a custom request that reasonably appears unlawful, unsafe, infringing or technically unsuitable.
You are responsible for claims resulting from material you submitted without the required permission.
11. TURBOSMOOTH DESIGNS AND WEBSITE CONTENT
Unless otherwise stated, the website and its contents—including product designs, photographs, renderings, graphics, logos, text, branding, layouts and original 3D models—are owned by or licensed to TurboSmooth.
Purchasing a physical product does not transfer ownership of the underlying digital model, design files, copyright, trademarks or manufacturing rights.
Without written permission, customers may not:
- copy or reproduce TurboSmooth’s digital designs;
- scan or reverse-engineer products for reproduction;
- manufacture substantially identical copies;
- download or redistribute protected website content;
- use TurboSmooth photographs to market competing products; or
- represent themselves as associated with TurboSmooth.
Nothing in these Terms prevents the lawful resale or gifting of a legitimately purchased physical product.
12. ORDER REVIEW AND ACCEPTANCE
An order confirmation acknowledges that we received your order. It does not necessarily mean that the order has been finally accepted.
We may review an order for:
- payment authorization;
- product availability;
- address accuracy;
- suspected fraud;
- pricing or technical errors;
- custom-production feasibility; and
- compliance with these Terms.
We may refuse or cancel an order before fulfilment where reasonably necessary.
If TurboSmooth cancels an order that has been paid and cannot be fulfilled, the amount collected for the cancelled product will be returned to the original payment method.
13. PRICING AND CURRENCY
Unless stated otherwise, prices are displayed in Canadian dollars.
Applicable GST, HST, provincial sales tax and shipping charges are calculated during checkout.
We may change product prices at any time. A price change will not normally affect an order already accepted, except where the listed price resulted from an obvious technical, typographical or system error and applicable law permits correction or cancellation.
TurboSmooth will not charge a higher price than the price accepted by the customer without obtaining the customer’s agreement.
14. PAYMENT
Payment must be completed using one of the payment methods available during checkout.
You authorize TurboSmooth and its payment processors to charge the total amount displayed before order confirmation.
Orders may be delayed or cancelled when:
- payment is declined;
- payment information cannot be verified;
- a transaction is flagged for possible fraud;
- the billing information is inaccurate; or
- additional verification is reasonably required.
TurboSmooth does not directly store complete payment-card numbers where payment is processed through an external payment provider.
15. PROMOTIONS AND DISCOUNT CODES
Promotional offers may be subject to:
- start and end dates;
- minimum purchase requirements;
- product or collection exclusions;
- one use per customer;
- geographic restrictions; and
- other conditions stated with the promotion.
Unless expressly permitted, discount codes cannot be combined, exchanged for cash or applied retroactively to completed orders.
We may cancel or correct a promotion affected by fraud, misuse or an obvious technical error, subject to applicable law.
16. ORDER CHANGES AND CANCELLATIONS
Customers should contact TurboSmooth immediately after ordering if a change or cancellation is required.
Requests submitted within 2 hours may be considered but are not guaranteed.
Once production, customization, printing, finishing or packing has started, an order may no longer be changed or cancelled.
Additional costs caused by a customer-requested change must be approved and paid before the change is completed.
17. SHIPPING AND DELIVERY
Shipping is governed by the TurboSmooth Shipping Policy, which forms part of these Terms.
Production and delivery dates are estimates unless TurboSmooth expressly confirms a guaranteed date in writing.
The customer is responsible for supplying an accurate and complete delivery address.
Mandatory consumer rights relating to materially delayed or undelivered orders remain unaffected.
18. RETURNS AND STORE CREDIT
Returns, final-sale products, damaged orders and store credit are governed by the TurboSmooth Return and Refund Policy.
Eligible voluntary returns receive store credit rather than a cash refund.
This store-credit rule does not override remedies that must be provided under applicable consumer-protection law.
19. ACCOUNTS AND PASSWORDS
If the website allows customer accounts, you are responsible for:
- maintaining the confidentiality of your password;
- restricting access to your device and account;
- providing accurate account information; and
- notifying us of suspected unauthorized access.
We may suspend or close an account reasonably believed to be used fraudulently, unlawfully or in violation of these Terms.
20. ACCEPTABLE WEBSITE USE
You must not:
- use the website for unlawful or fraudulent purposes;
- interfere with the website’s security or operation;
- attempt to access restricted systems or customer information;
- introduce viruses, malware or harmful code;
- scrape or extract website data through unauthorized automated means;
- impersonate another person;
- submit false reviews or fraudulent claims; or
- use the website in a way that violates another person’s rights.
21. REVIEWS AND CUSTOMER SUBMISSIONS
When you voluntarily submit a product review, photograph, testimonial or other content for publication, you grant TurboSmooth a non-exclusive, royalty-free licence to display, reproduce and format that submission for website, customer-service and promotional purposes.
We will not intentionally publish private order information, payment details or private communications as a testimonial without appropriate permission.
We may remove submissions that are abusive, fraudulent, unlawful, irrelevant or contain another person’s private information.
22. THIRD-PARTY SERVICES AND LINKS
The website may use or link to third-party services, including payment processors, shipping carriers, social-media platforms, analytics providers and Shopify services.
Third-party services operate under their own terms and privacy practices.
TurboSmooth is not responsible for the independent content or conduct of a third-party website. This does not limit responsibility that cannot legally be excluded.
23. WEBSITE AVAILABILITY
We try to keep the website accurate, secure and available, but we do not guarantee uninterrupted or error-free access.
The website may occasionally be unavailable because of:
- maintenance;
- hosting interruptions;
- technical failures;
- security incidents;
- software updates; or
- circumstances outside our reasonable control.
We may modify or discontinue website features without notice where reasonably necessary.
24. PRODUCT WARRANTIES AND CONSUMER RIGHTS
Products will be supplied in accordance with the applicable product description, approved custom specifications and mandatory legal warranties.
Except for rights or warranties that cannot legally be excluded, TurboSmooth does not make additional warranties regarding suitability for a purpose that the customer did not disclose and that TurboSmooth did not expressly accept in writing.
Nothing in these Terms excludes statutory warranties, consumer guarantees or remedies that cannot legally be waived.
25. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, TurboSmooth will not be liable for indirect, incidental, special or consequential losses arising from the use or misuse of a product, including loss of profits, business interruption or loss of data.
Where liability may legally be limited, TurboSmooth’s total liability relating to a particular product or order will not exceed the amount paid for the product giving rise to the claim.
These limitations do not apply to:
- fraud or intentional misconduct;
- gross negligence where liability cannot be excluded;
- personal injury caused by conduct for which liability cannot legally be limited;
- breach of a mandatory consumer-protection obligation; or
- any other liability that cannot legally be excluded or limited.
26. CUSTOMER RESPONSIBILITY
Customers are responsible for:
- selecting products appropriate for their intended use;
- reviewing measurements and descriptions;
- following care and safety instructions;
- supervising children and pets around small parts;
- protecting products from excessive heat;
- using appropriate hardware when installing or mounting a product; and
- stopping use if a product becomes cracked, damaged or unsafe.
27. INDEMNIFICATION
To the extent permitted by law, you agree to compensate TurboSmooth for reasonable losses, liabilities or expenses arising directly from:
- your unlawful use of the website;
- your material violation of these Terms;
- content or files you submitted without the required rights; or
- your unauthorized reproduction or commercial exploitation of TurboSmooth intellectual property.
This section does not require a consumer to compensate TurboSmooth for TurboSmooth’s own negligence or breach of law.
28. GOVERNING LAW
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada.
However, customers continue to receive any mandatory consumer protections available under the laws of the province or territory in which they reside.
Nothing in these Terms requires a consumer to waive a jurisdiction, remedy or legal protection that cannot legally be waived.
29. CHANGES TO THESE TERMS
We may update these Terms to reflect changes in our products, business practices, website functionality or legal requirements.
The revised Terms will be posted on TurboSmooth.ca with a new “Last updated” date.
Changes will not retroactively alter a completed order unless required by law or agreed upon with the customer.
30. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.
31. NO WAIVER
A failure by TurboSmooth to enforce a provision on one occasion does not waive the right to enforce that provision later.
32. ENTIRE AGREEMENT
These Terms, together with the product description, order confirmation, Return and Refund Policy, Shipping Policy, Privacy Policy and any approved custom quotation, form the agreement between TurboSmooth and the customer regarding the applicable purchase.
